What is the fundamental issue?
The "Helping Families Save Their Homes Act of 2009" included some provisions to protect tenants from eviction as a consequence of a foreclosure affecting the property being rented. Many examples were seen of families living in rental housing throughout the United States who were evicted without any prior notice when the home where they had lived was foreclosed upon. Much of the time, the rental family had no idea the home was in delinquency or subject to foreclosure until their eviction.

I have gotten a few requests for more details on the tax credit advancement.  The document attached was sent to us yesterday, which explains how the process will work.  However, there are no non-profit organizations in place yet that will actually do the transaction.   Probably in a month or so, we will be able to follow through with these transactions

First time homebuyers seem to have sensed a change in the Real Estate environment - they have decided that its now or never! The tax stimulus credit of $8000 is certainly helping - however I think it gos a Little deeper.

 I have always stated that buyers now know the market better than 90% of the agents who are working in the industry. I personally am seeing a reversal of roles in which buyers are sending their agents properties from my Charleston real estate search site . What value proposition are agents giving their buyers? Good question... when we start working with a new buyer we spend at least 1 hour interviewing them on their needs, expectations and what role they would like to pl...

Definition of a short sale is

A sale where the proceeds do not cover the lienholders lien - important to note that a short sale does NOT have to involve a bank - Please call if you have questions.

Second - please be aware of agents who will "put your home under contract" so that they can start bank negotiations....there may be a time and place for these actions but banks may now consider it a "flip" and even intent to defraud the lienholder. Some banks such as Suntrust will make short sales contingent upon an agreement that the home will not be "flippe...

Is the Tax Credit driving Buyers into the Real Estate Market?

The last few weeks have certainly been busy and at MarshallWalker.com and we are seeing a tremendous surge of first time homebuyers.  The $8000 tax credit is a huge advantage to a first time buyer but interest rates are also holding at record lows - FHA 30 year was quoted at 4.875% yesterday. If you are thinking about purchasing a home I recommend sooner than later....remember that this ta credit is only good till Dec 31,2009 - that means that you need to be under contract by Nov. at the latest....beware that the inventory for first time homebuyers is not very high (contrary to what you may read in the media)
